Selection methods have been under the spotlight recently, but we must not forget that there are also some specific requirements when notifying unsuccessful candidates. Today there are certainly many things we must ensure we do correctly, and this is somewhat different to years gone by, as demonstrated by a rejection letter from Walt Disney, addressed to a young woman who had inquired about a job as an animator in 1938. It certainly highlights the blunt gender inequality that plagued women before World War II, noting that “Women do not do any of the creative work in connection with preparing the cartoons for the screen.” Disney Rejection Letter

In cases such as NZAEPMU v Air New Zealand (2004) and Maritime Union v TLNZ Ltd (2007) the use of urine drug testing has been well examined by the Courts and was upheld as an appropriate method for these New Zealand employers to use in their endeavour of workplace safety. These decisions have since informed many other employers about how to approach their own workplace drug testing policy and procedures. Urine testing has been seen as accurate and able to detect a wide range of drugs in comparison to other methods.

As employers become familiar with the requirement to follow selection processes specified in their employment agreements and otherwise consult over the selection methods used in a restructuring process, the Employment Court has delivered a judgement (in Gilbert v Transfield Service (New Zealand) Ltd [2013]) that encourages employers to take another look at the selection tools they may use in a restructure process.
